First Stage of National Environment Law Reforms Begins

Australia’s first tranche of reforms to national environment laws has now commenced, marking an important milestone in overhauling the Environment Protection and Biodiversity Conservation (EPBC) framework.

Following the passage of the Environment Protection Reform Bills in November 2025, early changes have taken effect, with further stages to roll out through 2026. The reforms aim to strengthen environmental protection while delivering clearer, more efficient processes for industry and communities.

The latest “tranche 1” measures focus on quick wins, including streamlined assessment pathways, improved information sharing between agencies, clearer national interest exemption provisions and stronger transparency around expert advice, including greater recognition of First Nations knowledge.

Proponents can now surrender unused approvals with ministerial consent, and strategic assessments have been updated to better align with future National Environmental Standards. Wildlife trade approvals have also been simplified and extended.

Looking ahead, major reforms will commence on 1 July 2026 with the establishment of a new independent National Environmental Protection Agency to strengthen compliance and enforcement. A new Head of Environment Information Australia will also improve public access to environmental data.

All remaining reforms are expected to be operational by 1 December 2026, completing Australia’s transition to a modernised national environmental framework.
